    What you are overlooking is who has a right over another, I am of the opinion I have a greater right to live upon my property undisturbed or threatened than a drone operator has to fly over it, if you want to fly over private property buy your own and fly all day long. If you want to fly over my property you have better obtain my permission prior to doing so.

    This concept is becoming backed by the various laws and regulations being enacted which clearly state such, heck even the FAA is on board with a similar idea, "small unmanned aircraft may not operate over any person not directly involved in the operation."

    So fly all you want, just stay over your property or within a designated area that allows such.

    Thinking you have a greater right, when you have no such right to begin with, to disturb, harass or threaten someone else with an unregistered, uncertified machine of questionable origin and design, is ludicrous and very self centered.

    That actually just happened here locally and the cops did not arrest the guy even though people were pretty upset about it.

    While he may have avoided being arrested, I am very willing to bet the police and subsequently the parents have not forgotten his name and address.

    God help anyone who tries to turn around in Wayne's driveway. He doesn't know who they are. He doesn't know their not here to rob and murder him. He doesn't know their car isn't full of loaded guns or maybe even rigged to explode. His only reasonable action is to shoot first just to be safe. They are on his property after all.

    Sarcasm aside. You have to show that a reasonable person would see imminent danger to life or property to use the "it was threatening me" defense. Good luck on that if the pilot has video showing it's several hundred feet away and not moving towards you. Otherwise your legal recourse is not property destruction but instead to call the police and have them deal with the issue.
