    Trappy appeal brief

    Here is the brief we filed today opposing the FAA's appeal in Trappy's case.

    A new doc that came out of this shows that an FAA internal investigation determined Trappy broke no laws.

    The FAA is just pissed because they have no authority, so they're now in the business of intimidation until something can be officially legislated.

    There's also an article on Motherboard about Texas Equisearch (however you spell it) saying that the FAA has essentially admitted it's cease and desist orders are not legal orders, thus don't need to be followed. I'll see if I can grab a link

    If the FAA lost, how are they able to file an appeal. Is that not double jeopardy?

    I'm sure there's an appeals process just like for regular criminal cases except since this isn't a criminal charge per se I'm sure either side is able to appeal. Then again I'm not a lawyer

    Any judgement decided in U.S. courts can be appealed up to the Supreme Court. It's not only a crucial part of the American justice system, it's probably the most crucial part. The right to appeal is a remedy against biased judges, juries, inadequate representation, and other problems that occur in the courts system. Filing an appeal is much, much easier to do than actually winning on appeal.

    No he is not being re-charged, the FAA just disagrees with the ALJ's decision.
